Arrested at an Italian airport: the three situations

Airport arrests fall into a small number of recurring situations, and the defence in each is completely different. Something was found on you or in your luggage; you were stopped on an alert relating to another case; or you were stopped over cash, goods or documents. Knowing which one applies decides everything that follows.
Something was found in the luggage
Where drugs are concerned, three scenarios sit behind superficially identical facts, and conflating them is the most common error.
- The knowing courier. The defence works on the bracket: quantity of pure substance, the role played, and whether the case can be brought within the lesser offence.
- The internal carrier. A medical situation before it is a legal one. Health comes first and the record of what was done, and when, matters later.
- The person who did not know. A bag packed by someone else, a case carried as a favour, a vehicle belonging to another. Attribution has to be proved, not inferred from possession, and the evidence for it — messages, who booked the ticket, who paid — has to be secured immediately.

Stopped because of an alert, not because of what you carried
This is the situation nobody expects and it is entirely different. A border check produces a hit: a European Arrest Warrant, an Interpol Red Notice, a Schengen alert, or an unserved sentence in another country. Nothing was found; the person is the subject of a request.
These cases turn on the underlying measure in the other country, not on anything that happened at the airport. Being stopped in transit counts. Passing through an Italian airport on the way somewhere else is enough for an alert to be acted on.

Two of these regularly catch honest travellers. A firearm or ammunition lawfully owned in another country becomes an offence the moment it is in a bag here. And a folding knife bought as a souvenir is an offence to carry without a justifying reason, with a penalty that was increased in 2023.
What applies in the airport police office
The same rules as anywhere else. You must give your identity and refusing is a minor offence; you are not obliged to answer about the facts; the interpreter is free; you should not sign an Italian record you have not had translated. Being taken to an office for identification is not an arrest and cannot exceed twelve hours, or twenty-four in the cases the law allows.
What is different is the pressure. There is a flight, a connection, a family waiting, and people say things to make it stop. Almost every damaging statement in these files was made in the first hour by someone who wanted to catch a plane.
