Alternatives to prison in Italy: serving a sentence outside

A custodial sentence in Italy does not automatically mean prison. Where the sentence, or what remains of it, falls within certain limits, it can be served under supervision outside. And there is a window that decides everything: when the enforcement order is served, its effect is suspended for thirty days so that an application can be made.

The thirty days

Where the sentence to be served is within the limits set by the code, the prosecutor issues the enforcement order and simultaneously suspends it, notifying that an application for an alternative measure may be made within thirty days.

If the application is not made, the suspension lapses and the person goes into custody. This is the most common way in which people lose access to a measure they would have obtained — not on the merits, but because nobody explained what the notice meant. For someone abroad, or someone who has moved, it is worse: the notice arrives at an address that may no longer be theirs.

Early release is the one that changes everything else. It shortens the sentence for each six-month period served with participation in the rehabilitative programme, and a shorter residual can bring the person below the thresholds for every other measure. It is calculated on the aggregate of sentences, which is why an error in that calculation produces the wrong answer everywhere.

What an application actually needs

The measures are not granted on the sentence alone. They are granted on a prognosis, and the prognosis is built from documents.

  • A suitable address, with the written agreement of whoever lives there and proof of the property or lease.
  • Work, or a concrete offer of it. This is the element that weighs most.
  • Engagement of the local social services, and where relevant of the addiction service.
  • Reparation towards the victim, even partial: it bears directly on the assessment.
  • An accurate calculation of the aggregate sentence, the early release already granted and time already served.

For someone who is not Italian

Nationality is not a bar and residence abroad is not automatically fatal, but two obstacles are real: an address in Italy for the measure to be executed at, and an occupation that can be verified here. Where neither exists, the realistic route is often transfer of the sentence instead, dealt with in serving an Italian sentence at home.

Where the person is subject to expulsion, expulsion as a substitute for the residual sentence exists as a separate route, dealt with in criminal charges and the right to remain.

What ends a measure

Breach of the conditions can lead to revocation and return to prison for the residual sentence. For home detention there is an additional consequence: leaving the place of execution is itself the offence of escape, dealt with in the guide on house arrest.
