Arrested in Cyprus: 24 hours to court, then the remand order

Direct answer

Cyprus imposes an express obligation on the police: an arrested person must be brought before a court as soon as possible and in any case no later than 24 hours after the arrest. The court then inquires into the grounds of the arrest and either releases the person on such terms as it thinks fit, or remands them in custody.

The witness point is the one that catches people. The mere possibility of influencing witnesses is itself sufficient ground for a remand order, which means a case with several people involved — a fight, a group incident — carries a real risk of custody even where nothing else points to it.

What actually happens here

  • Resort nightlife. Limassol, Ayia Napa and Protaras produce fights, public order and drug cases concentrated into the season, involving people who leave within days.
  • Drugs at clubs and festivals, where Cypriot law is stricter than the reputation of the resorts suggests.
  • The ports and the marina, with shipping, yachts and the customs cases that follow.
  • Financial and corporate proceedings, in a jurisdiction built on company formation and services, frequently arising from requests originating elsewhere.
  • The resident foreign community, with the cases of residents: driving, property, neighbours.
  • Property disputes, which turn into fraud complaints with some regularity.

For anyone with a Cypriot company or account, the recurring situation is not a Cypriot prosecution but a Cypriot dimension of a case running elsewhere: records requested here, accounts frozen here, a structure examined here.

One island, two systems

Cyprus is divided, and the northern part is not under the control of the Republic. What happens there is outside the system described on this page, and the practical consequences — for arrest, for documents, for any request for assistance — are entirely different. Establishing which side an incident occurred on is the first question, not a detail.

Where an Italian lawyer comes in

Only a lawyer admitted in Cyprus can appear before its courts. The Italian side covers the rest: selecting and briefing that lawyer, explaining the position to the family in their own language, and handling anything with an Italian end — a parallel proceeding, a warrant issued by Italy, an alert in circulation. The model is in how a correspondent case is run.

Frequently asked questions

How long can Cypriot police hold me?

You must be brought before a court as soon as possible and in any case no later than twenty-four hours after the arrest.

Why was I remanded when the case seems minor?

The possibility of influencing witnesses is in itself sufficient ground for a remand order, which matters in any case with several people involved.

Who decides whether to prosecute?

The Attorney-General, after the police inquiry is complete, then refers the case to court if there is sufficient evidence.

What if the incident happened in the north?

That is outside the system of the Republic, and the consequences for arrest, documents and assistance are entirely different. Establishing which side it occurred on comes first.
