Drug arrest in Sweden: where using is itself an offence

Sweden is the European country where the act of consumption is itself a criminal offence. Not possession alone: using. That single feature changes everything about how these cases begin, because it means the evidence can be in your body rather than in your pocket.

What that means in practice

Where police have reasonable suspicion that a person has used a narcotic, they may require a test. A positive result establishes the offence, and no substance needs to be found at all. Someone who consumed elsewhere — in a country where it was lawful — and arrives here can still be committing an offence on Swedish soil.

For visitors this is genuinely counter-intuitive. Having taken something in Amsterdam or Berlin and flown to Stockholm is not a historical fact in Swedish law: if it is still detectable, the offence is present.
