The distinction that decides these cases is not between wanting a fire and not wanting one. It is between a fire that spread beyond control through carelessness — which is fully criminal — and one that did not spread at all. Nobody who lights a barbecue intends a wildfire, and nobody needs to.
Summer, and the rules that change by the week
Regions and municipalities issue orders prohibiting the lighting of fires during high-risk periods, and those periods, their boundaries and their conditions differ from one area to another and from one year to another. Conduct that was lawful in May can be an offence in July a few kilometres away.
For someone who owns or rents property in the countryside this is a practical trap: burning garden waste and pruning is normal agricultural practice within limits, and outside those limits it falls under the rules on waste, dealt with in regulatory prosecutions.

These cases are decided by the technical reconstruction of the origin and spread of the fire, and by the meteorological and site conditions.
