Homicide and serious violence charges in Italy

The line between wanting the death and wanting the blow

Homicide beyond intention covers the person who set out to strike or injure and caused a death they did not want. It is not a mitigating circumstance: it is a separate offence, and the gap between it and intentional homicide is more than a decade.

The assessment is made on the conduct rather than on what the person says afterwards. The part of the body struck, the instrument used, the force, whether blows were repeated, whether anything was done afterwards to help: these are what the courts examine, and it is why the technical reconstruction and the medical evidence matter more here than any account.

Above it sits intention in the form the Italian courts call indirect: the person did not aim at the death but accepted it as a possible consequence and acted anyway. The boundary between that and conscious negligence is the most contested question in this whole area, and it is argued on the same materials.

What turns it into life imprisonment

The code lists the circumstances: certain relationships between the parties, particular motives, cruelty, concealment of another offence, and others. Their presence is not a matter of degree — it changes the penalty to life imprisonment — so whether each one genuinely applies is examined individually and is a central part of the defence.

Circumstances reducing the penalty operate in the other direction, and among them the reaction to a wrongful act by the victim, and provocation, arise regularly in cases that began as a confrontation between two people.

What the defence works on

  • Self-defence, and exceeding its limits. Where a genuine defensive situation existed but the response went beyond it through misjudgement, the offence becomes a negligent one. The framework is in fights and assault in Italy.
  • Causation. Where other causes contributed to the death, including medical treatment, the question is whether the conduct remains the cause in law.
  • The technical reconstruction. These cases are decided by experts, and the defence expert must be appointed before the post-mortem, not after it.
  • Capacity. Where a mental condition is in issue, it affects both liability and the measures that follow.
  • Attribution. Where several people were involved, who did what, and whether a participant is liable for a consequence beyond the common design.

How these proceedings run

Detention is effectively the norm and the first decisions are taken within days. The most serious offences are tried before the assize court, composed of two professional and six lay judges deliberating together on both fact and sentence — the only Italian court with lay participation.
