Carrying a knife

Italy distinguishes between weapons proper and objects capable of causing injury. A folding knife bought as a souvenir, a multi-tool, a utility knife in a rucksack: carrying any of them outside your home without a justifying reason is an offence, and the penalty was raised in 2023 to detention of one to three years.

The defence is the justifying reason, and it is assessed in context: the hour, the place, whether the object is connected to an activity actually under way, where it was kept. What you say and write

Defamation is a criminal offence in Italy, not merely a civil wrong. A post, a review, a message in a group chat readable by several people all satisfy the requirement. Visitors from systems where this is purely a matter for civil courts are routinely astonished to receive a criminal complaint over a review.

The mirror image is also counter-intuitive: insult between private individuals stopped being a crime in 2016 and is now a civil matter. So insulting someone to their face is not an offence, while damaging their reputation in their absence is.

Insulting a police officer is different again and is a distinct offence with its own conditions, set out in public order offences.

Souvenirs from protected sites

Removing stones, fragments, sand or archaeological material from a protected site or a protected beach is an offence, and offences against cultural heritage were consolidated into the Criminal Code by legislation in 2022 with substantially increased penalties.

The same applies to taking objects out of the country: exporting cultural property without authorisation is an offence in its own right, and customs at airports do check. What travellers treat as a memento is, in the wrong circumstances, a criminal file.

Counterfeit goods

Buying a counterfeit bag or a pair of sunglasses from a street seller exposes the purchaser to a substantial administrative penalty and to seizure of the item. Selling them, or bringing in quantities beyond personal use, moves the matter into criminal territory under the provisions on goods bearing false marks.

The rest of the list

• Cannabis. Not legal, whatever the shops selling low-THC hemp suggest, and importing it from a country where it is lawful is an importation.
• Driving. The criminal threshold is 0.8 grams per litre, lower than in several countries visitors come from, and refusing the test is punished as the worst band.
• Public order. Conduct treated as a nuisance elsewhere — obstructing an officer, refusing to identify yourself — is an offence here.
• Images. Sending or publishing sexually explicit images of someone without consent is a specific criminal offence.
• Firearms. A weapon or ammunition lawfully held at home becomes an offence the moment it is in a bag in Italy.

Why this list matters more than it looks

None of these produces a long sentence in an ordinary case. What they produce is a criminal file, and a criminal file has consequences that outlast the trip: a record, effects on residence status where relevant, and the need to deal with an Italian proceeding from abroad.

Most of them can also be resolved early, through the routes that end a case without a conviction. That is the reason to take them seriously at the start rather than after the summons arrives.
