Limitation periods in Italy: when a case can no longer proceed

Two different mechanisms now limit the duration of an Italian criminal case, and they are constantly confused. Limitation runs from the offence and stops permanently at the first-instance judgment. After that, separate outer limits apply to the appeal stages — two years and one year — and exceeding them makes the prosecution inadmissible.
How limitation works

The last line is the important change. Until recently limitation continued through the appeals; now it stops at the first-instance judgment, whether that judgment convicts or acquits. Anyone relying on English-language material written before that will get the answer wrong.
What replaced it
Outer limits on the stages. The appeal must be concluded within two years and the Court of Cassation within one, extendable in complex proceedings by decision of the court. Where a stage exceeds its limit, the prosecution becomes inadmissible and the proceedings end.

Acts that restart the clock
Certain acts interrupt limitation and restart the period: the order applying a precautionary measure, the questioning of the person under investigation, the invitation to appear, the request for committal, the summons to trial and others listed in the code.
Interruption is not unlimited: the total period cannot exceed the basic period increased by a fraction fixed by law, higher for those with previous convictions. Calculating the actual expiry therefore requires the whole procedural history, and it is a calculation rather than an estimate.
You can decline it
A defendant may expressly waive limitation. It is a real decision and not merely theoretical: a case that ends by limitation ends without a finding, while a defendant who expects an acquittal on the merits may prefer the judgment.
It matters most for someone whose position will be examined elsewhere — for employment, for a licence, for immigration purposes — because a decision on the merits answers the question in a way that expiry does not.
What it means in practice
- Expiry is not automatic in the sense of the file disappearing: it is declared, and it can be raised.
- The calculation depends on the offence as charged, so a reclassification changes it.
- Aggravating circumstances that raise the maximum sentence extend the period.
- For continuing offences, when the conduct ceased is itself frequently contested.
- Time spent on an appeal you brought is not time you can complain about later.
