Drug arrest in the Netherlands: the Opium Act and two lists

The Dutch Opium Act divides substances into two lists: those considered to pose unacceptable risk, and the rest. What visitors call legalisation is a policy of non-prosecution applied to small quantities from the second list in licensed premises. It is not legalisation, it does not extend to the first list, and it does not travel.

The point that produces most visitor cases is the last one. Buying lawfully in Amsterdam and carrying the purchase to Germany, Belgium or France is an export at one end and an importation at the other, and importation is treated far more seriously than possession everywhere in Europe.

MDMA is not tolerated

This is the assumption that does the damage. The Netherlands is a major producer of MDMA and amphetamines, and precisely because of that the enforcement against them is intense. Possession of MDMA is a List I matter and is prosecuted, and a festival search that finds it produces a criminal file rather than a fine.

Street purchases are worse again: what is sold to tourists frequently is not what it was said to be, which adds an unpredictable substance to an already criminal position.

Where the serious cases are

Dutch drug prosecutions concentrate on production and export: laboratories, precursor chemicals, and the container flows through Rotterdam.
