Interpreters and translation in Italian proceedings
A person who does not know Italian is entitled to an interpreter free of charge, regardless of income and regardless of the outcome of the case, and to written translation of the essential documents. Both rights exist under Article 143 of the Code of Criminal Procedure, and both are frequently not given unless they are asked for.
Free means free
This is not legal aid and it is not conditional on your means. The cost is not recovered from you if you are convicted, and it does not depend on the seriousness of the case. It is a separate guarantee, derived from a European directive and implemented in the code.
It covers the hearings and the acts of the proceedings, and it also covers conversations with your own lawyer where they are necessary to prepare an act — which is the part most often overlooked, because people assume the interpreter is there for the court rather than for them.

Translation must be provided within a reasonable period. The test is not conversational Italian
The question is not whether you can order a coffee. It is whether you can follow a charge, understand a question put in legal terms, and read a document that decides your position. Someone who lives in Italy and works in Italian may still be entitled to translation of a charge sheet.
The assessment is made by the authority, often on the basis of a brief exchange at the identification stage, and it then hardens. If you cannot follow, say so immediately and ask for it to be recorded — a statement made at that point carries far more weight than a complaint months later.
When the interpretation is not adequate
Two situations recur. The interpreter works into a language you speak only superficially, because no interpreter was available for your own; or the interpretation is plainly summarising rather than translating.
- Say so at the time and ask for it to be noted in the record of the hearing.
- Ask for the specific language or dialect where the one offered is not genuinely yours.
- Where a written statement is to be signed, ask for it to be read back in full through the interpreter before signing.
- Where a translation of a document is inaccurate on a decisive point, raise it as soon as it is noticed.
Objections raised at the time can affect the validity of the act. Objections raised months later are argued about rather than accepted, and they carry a fraction of the weight.
The rule that prevents most of the damage
Do not sign a document in a language you do not read. Records of questioning, of searches and of seizures are drafted in Italian and summarise what was said; the summary becomes the account you will be dealing with for the rest of the case.
Asking for an interpreter before signing is not obstruction and does not aggravate your position. It is the single most protective thing a person can do in the first hours, and it is dealt with further in the guide on being stopped and questioned.
