Drug arrest in Spain: an offence against public health

Spain does not have an offence of drug possession. It has offences against public health, which punish cultivation, production and trafficking — and it treats possession for one's own consumption differently: in a public place it is an administrative matter, and in private it is not sanctioned at all.

The two-band structure is the first thing to establish in any Spanish case, because the same conduct with a different substance sits in a different bracket. The second is whether an aggravating circumstance is alleged: quantity of notorious importance changes the sentence more than anything else in the file.

Where personal use ends

There is no fixed figure. The courts weigh the amount against the setting: how it was divided, whether scales or packaging were present, cash carried, messages on the phone, and where the person was found.

The consequence is that the same quantity produces opposite outcomes. Held in one piece, with no cash and no messages, it points to consumption; the same weight in ten wraps points to supply. And passing something to a friend, even at cost, can meet the definition of trafficking.

The cannabis association question

Spain has a large number of cannabis associations, and their legal position has been repeatedly litigated. Membership does not create a safe harbour: prosecutions of associations and their members have succeeded, and a visitor signed up at the door on arrival is in a considerably weaker position than a long-standing member.

For a foreign visitor the practical advice is simple. Anything obtained through an association and then carried outside it is possession in a public place at best, and evidence of supply at worst.
